Zubedo, Copyright Infringement Notice
In uploading media content to Zubedo, you hereby consent that you are the media creator or owner, or have the authority of the media creator or owner to upload and distribute the media content through Zubedo.
If you believe that copyright or other intellectual property rights may have been infringed then you should email the Zubedo Copyright Protection Unit at ocopyrightunit@zubedo.com, providing us with details of the following information (this email will hereinafter be referred to as the “Copyright Infringement Notice”):
Your Zubedo username including a suitable, current, working email address (this will help us to identify and then correspond with you).
The name of the media item (song, album, music video, film, television, radio, video etc), along with the full URL for the relevant playback page (this will help us to identify the media file that is allegedly breaching copyright).
Provide a brief explanation of how you believe the media file breaches copyright. This should be in the form of, “I believe the media file enter full URL here breaches copyright because enter your reason here”. This could be, for example, because the media file includes original sound-track from copyrighted material, or because you believe it contains video footage from an original copyrighted work (this allows us to understand the precise nature of the alleged copyright infringement).
Where you are the creator, media or copyright owner, include details of the countries where the copyright breach is alleged to have occurred (this will assist the Zubedo Copyright Protection Unit in potentially blocking the highlighted media content to the countries where the copyright breach is alleged to have occurred, pending investigation by Zubedo).
Where possible, provide us with the name of the copyright owner, their address, and if they are a Zubedoer their Zubedo username and registered Zubedo email address (if you are aware of this), including a URL link to the original copyrighted work which you believe has been infringed (this will help our Copyright Protection Unit to liaise with the copyright owner with a view to investigating the alleged copyright infringement).
Include the following good faith statement: "I genuinely believe that the use of, or incorporation of the above mentioned media, is not authorised by the copyright owner, or by a legal representative of the copyright owner, and is therefore an infringement of copyright” (this statement is intended to prevent spurious claims in relation to copyright infringement, and lets Zubedo know that you genuinely believe that the infringement notice you are serving is valid). Finally include the following text in your communication to us: “I hereby confirm that the information outlined in this notification is true and accurate, and that I or other third parties referred to within this communication have the right to commence legal proceedings in respect of this alleged infringement of copyright (this statement helps deter misleading or fraudulent copyright claims).
Finally, please sign the copyright infringement notice and then scan and email this document to ocopyrightunit@zubedo.com.
Please note that in submitting a Copyright Infringement Notice, you hereby consent to Zubedo contacting you directly, and/or forwarding your contact details, along with the details of the alleged copyright infringement to the copyright owner, and/or any other third party organisations (including for the avoidance of doubt law enforcement agencies) with a view to resolving the alleged copyright infringement. Please note that in submitting a formal “Copyright Infringement Notice”, the Zubedo Copyright & Royalty Collection Unit may at its absolute discretion, and without any liability attaching whatsoever (whether in contract or tort, and whether in the United Kingdom or overseas) to Zubedo, its officers, employees, agents, representatives or partners remove the media content, that forms the basis of the alleged copyright infringement, from the Zubedo site pending investigation.
For the avoidance of doubt, if any alleged Copyright Infringement Notice is found to be invalid, or unenforceable or if such notice is generally lacking in provenance (whether determined by a court of competent jurisdiction, a relevant professional body or association duly appointed in respect of the alleged copyright infringement, or by Zubedo itself), then the individual or party making the alleged infringement of copyright, and/or who has submitted the Copyright Protection Notice shall fully indemnify Zubedo in respect of any compensation (whether in respect of loss or revenues, or whether by way of damages, or whether by way of an ex-gratia payment) which it is ordered to pay, or which it otherwise agrees to, or offers to pay to the party alleged to have committed the infringement of copyright (irrespective of whether they are a Zubedoer or not), along with any costs, fees, expenses or otherwise associated with dealing with the alleged infringement of copyright.
As such, please ensure that you “know whether the content that you have seen on Zubedo infringes your copyright, or the copyright of others” before submitting a Copyright Infringement Notice. If you are not sure what your rights are then you should consult a suitably qualified legal adviser before submitting a Copyright Protection Notice to Zubedo. Be aware that there may be adverse legal consequences in your country if you make a false or bad faith allegation of copyright infringement. Please do not make a claim for breach of copyright, especially if you know (or should reasonably have known) it to be false or untrue, or if someone else has asked you to make the claim on their behalf (without first qualifying the extent of the claim directly yourself), as it could have legal and/or financial consequences
If you wish to report general abuse, harassment, inappropriate content or advise us of a privacy complaint then you should email reportabuse@zubedo.com , providing us with as much information as you can about the circumstances that have led to the complaint including your username, your current, working email address, the username of the person that forms the basis of the complaint, information relating to the media file in question, along with the URL page, as well as a general description of the complaint including the date and time that it took place. Zubedo will then investigate your complaint as quickly as possible, and contact you via your chosen or preferred method of communication (email is quicker).
Lastly, please remember that all use, and uploading of media content to Zubedo is subject to Zubedo's terms and conditions of business, which for the avoidance of doubt, may change from time to time.
